These Product-Specific Terms are incorporated into and form part of the SecuriGene Consumer Terms and Conditions (the “Master Terms”). Except as expressly modified herein, the Master Terms apply in full to this product. In the event of any conflict, these Product-Specific Terms control solely with respect to these products.
Acknowledgements
You acknowledge and agree to the following:
You authorize SecuriGene (and its affiliates and partners) to conduct DNA testing with the submitted DNA sample.
You understand re-collection may be required if the sample submitted is insufficient, and that additional fees will apply.
You understand that if an insufficient sample is identified, testing time is not guaranteed.
You represent and warrant that you have obtained all permissions, consents, and legal authorizations necessary to submit any biological samples, personal data, or information, including valid consent from all individuals whose samples are submitted, or from a parent or legal guardian where applicable.
You understand that samples collected without proper chain of custody cannot be verified and therefore, my results may not be admissible in a court of law.
You understand genetic mutations may sometimes occur in a small percentage of cases, and if a mutation occurs, any guarantees on conclusiveness, probability and turnaround time are void.
You understand results are provided solely within the Platform and are not provided by e-mail, mail or over the phone.
You understand it is your responsibility to provide accurate information during activation, and safeguard your login credentials.
You understand once results are released, testing is complete and the file is closed.
You understand SecuriGene is not liable for any delay, loss, damage, misdelivery or non-delivery by USPS, UPS, FedEx or any third-party carrier.
Turnaround Times
The laboratory’s highest priority is the accuracy and quality of testing. While SecuriGene aims to complete testing as quickly as possible, turnaround times cannot be guaranteed. Testing will not be expedited at the expense of accuracy. As with any biological testing, specific situations may delay or void the turnaround time, including but not limited to:
- Poor sample quality;
- Non-compliant sample;
- Failure to follow one or more of the collection instructions;
- Mutations;
- Low paternity or kinship index;
- Incest or related parties; or
- Incest or related alleged fathers.
In such cases additional testing or re-collection may be required at an additional cost. If testing cannot proceed, there is missing information and/or you fail to respond to SecuriGene’s notices, your order will be placed on hold after 90 days and marked as dormant. If no response is received within 180 days from initial notice, the order may be cancelled and the account closed.
Amendments to Test Type
The type of kinship test originally ordered may be amended (i.e. from a paternity test to a sibling test) for an additional charge, at SecuriGene’s sole discretion. If applicable, the cost of a new collection kit plus shipping and handling may apply.
Existing Profiles
In some cases, an existing DNA profile may be used in a new DNA test, however certain conditions must be met, and proper authorizations must be provided. The full cost of the new test will apply regardless of whether an existing profile is used. SecuriGene reserves the right to deny use of an existing profile at its sole discretion.
DNA Kit Expiration
Each type of DNA testing kit has a defined validity period. Samples must be collected and received by the laboratory within the applicable period for the kit you purchased. Current expiration periods are published on the SecuriGene website and may vary by kit type.
If samples are not received within the applicable period, your account and/or activation code will be inactivated. A reactivation fee of $50 USD will apply to reopen your account and continue testing, subject to the sole discretion of the laboratory.
